Parental Consent Policy

1. Introduction

This Parental Consent Policy ("Policy") governs the collection of parental consent and the use of the Amavit Abacus Platform, including its website, mobile applications, web application, and related services (collectively, the "Platform"), by children.

This Policy establishes the procedures for providing and confirming parental consent, as well as the rights and responsibilities of Parents when Children use the Platform.

This Policy should be read together with the Company's Terms of Use, Privacy Policy, and Children's Privacy Policy.

2. Age Requirement

The Platform is intended for Children aged 5 years and older.

Children may use the Platform only under the supervision of a Parent, legal guardian, or another authorized adult where permitted by applicable law.

3. Registration of Children

Children are not permitted to create Accounts independently.

A Child's Account may only be created by:

  • a Parent;
  • a Teacher; or
  • another authorized adult, where permitted by applicable law.

When creating a Child's Account, the Parent or Teacher confirms that they have the legal authority to create the Account and provide the necessary information.

Where required by applicable law, Teachers are responsible for obtaining all necessary parental or legal guardian consents before creating or managing a Child's Account.

Child information is entered by a Parent, Teacher, or another authorized adult User.

By registering a Child, the registering User confirms that:

  • they are at least 18 years of age;
  • they are a Parent, legal guardian, Teacher acting with appropriate authorization, or another authorized adult permitted to create the Account;
  • they have the legal authority to provide the required consents.

The Company may reasonably rely on the information provided by Users during registration and shall not be liable for missing or invalid parental consent if inaccurate, false, or misleading information was provided by the registering User.

4. Parent Control

The Parent or another authorized adult User maintains primary control over the Child's use of the Platform.

Depending on the Platform's available functionality, the Parent may:

  • manage the Child's Account;
  • modify the Child's profile information;
  • change the Child's PIN or other authentication settings;
  • control the Child's access to the Platform;
  • review the Child's educational progress;
  • manage available settings and permissions.

A Child may access the Platform:

  • through the Parent's Account;
  • through a dedicated Child interface using a PIN code;
  • through other authentication methods supported by the Platform.

5. Parent Responsibilities

The Parent is responsible for:

  • ensuring the accuracy of information provided about the Child;
  • supervising the Child's use of the Platform;
  • the Child's activities performed through the Account;
  • compliance with the Platform's legal documents;
  • protecting their own Account credentials;
  • preventing unauthorized access to the Child's Account.

6. Processing of Children's Personal Data

Children's personal data is processed solely for the purposes of operating, maintaining, securing, and improving the Platform and providing educational services.

The Company receives and processes Children's personal data exclusively through:

  • Parents;
  • Teachers;
  • other authorized adult Users; and
  • the Child's use of the Platform under their supervision.

The Company does not knowingly establish direct relationships with Children outside the supervision or authorization of a Parent, Teacher, or another authorized adult.

The processing of Children's personal data is further described in the Privacy Policy and the Children's Privacy Policy.

7. Parent Rights

Subject to applicable law, Parents or other authorized adult Users may:

  • access the Child's personal data;
  • correct inaccurate information;
  • request deletion of personal data;
  • restrict certain processing activities;
  • request a copy of the Child's personal data;
  • withdraw previously provided consent.

The Company may request reasonable verification of identity before fulfilling such requests.

8. Deletion of a Child's Account

A Parent may request that a Child's Account be deleted at any time.

Following such a request, the Company will delete or anonymize the Child's personal data within a reasonable period, unless continued retention is required:

  • by applicable law;
  • to comply with legal obligations;
  • to resolve disputes;
  • to establish, exercise, or defend legal claims;
  • to protect the security and integrity of the Platform.

9. Restrictions on Children's Use

Children may not:

  • create Accounts independently;
  • use the Platform without the involvement of a Parent or another authorized adult where required;
  • independently purchase subscriptions or Premium features;
  • modify Parent-controlled settings;
  • independently provide legally valid consent for the processing of personal data where such consent must be given by a Parent under applicable law.

10. Confirmation of Parental Consent

By allowing a Child to use the Platform, the Parent confirms that:

  • they consent to the Child's use of the Platform;
  • they have read and accepted this Policy;
  • they have reviewed the Terms of Use, Privacy Policy, and Children's Privacy Policy;
  • they possess the legal authority necessary to provide such consent.

11. Withdrawal of Consent

A Parent may withdraw previously granted consent at any time by contacting the Company.

Upon receipt of a valid withdrawal request, the Company will cease processing the Child's personal data and delete or anonymize the relevant information, unless continued processing is required or permitted by applicable law.

Withdrawal of consent may result in the suspension or termination of the Child's access to the Platform.

12. Changes to this Policy

The Company may update this Policy from time to time.

The most current version will always be published on the Platform's website together with its updated Effective Date.

Continued use of the Platform after changes become effective constitutes acknowledgment of the revised Policy, where permitted by applicable law.
